Based upon Notice no. 1 of the Federal Networks Agency of 17.10.2008 to implement the “GABi Gas” resolution of 28.05.2008 (Ref.: BK7-08-002) Thyssengas is, from 18 October 2008 until 1 April 2010, using the price index “APX Gas UK OCM SAP” instead of the index “APX Gas UK NBP” as the index relevant to the National Balancing Point for calculation of the balancing energy charges and to calculate the structuring contribution per § 29 (3a) in conjunction with § 27 (2 and 3) of Annex 3 to KoV III.

With its Notice no. 2 of 23.12.2008 to implement the “GABi Gas” resolution of 28.05.2008 (Ref.: BK7-08-002), the Federal Networks Agency authorised and obliged the balancing group network operators, in the event of a lack of current daily reference prices, to apply the most recent value published.

In its Notice no. 4 of 24.03.2010 to implement the “GABi Gas” resolution of 28.05.2008 (Ref.: BK7-08-002), the Federal Networks Agency had provided that, in superseding the Notice no. 1, the price index “EEX Gaspool Day-Ahead” should be used from 01.04.2010 instead of the price index “APX UK ACM SAP“ in determining the settlement energy prices. In addition, the Notice provides for an adjustment of the factor for positive settlement energy from 1.1 to 1.2. Thyssengas will apply Notice no. 4 to determine the settlement energy prices from 01.04.2010.
